Right of withdrawal (14 days)
A Consumer, and an entrepreneur with consumer rights, may withdraw from a distance contract within 14 days without giving reasons. The period runs from the day the item is taken into possession (for Digital content – from the day the contract is concluded). To withdraw, send an unequivocal statement by e-mail to fetish.businesswoman@gmail.com or by post to: Bangla Unlimited Karol Otręba, ul. Mickiewicza 23/1, 76-200 Słupsk, Poland, Tax ID (NIP) 8392860752. You may use the model form below, but it is not mandatory.
The item must be returned to the above address no later than 14 days after the withdrawal statement. The direct cost of return is borne by the buyer.
We refund all payments received, including delivery costs (up to the cheapest delivery option offered), without undue delay and in any event within 14 days of receiving the statement, using the same payment method as the buyer used, unless the buyer expressly agrees to another method at no cost. We may withhold the refund until we receive the item back or proof of its dispatch, whichever is earlier.
Exceptions – when the right of withdrawal does not apply
Under Article 38(1) of the Polish Consumer Rights Act, the right of withdrawal does not apply to contracts:
- for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons once unsealed after delivery (point 5) – this concerns lingerie, tights, stockings and other personal items, which we ship in hermetically sealed packaging marked with the information that opening it excludes the right of withdrawal for hygiene reasons;
- for the supply of goods made to the Consumer’s specifications or clearly personalised (point 3);
- for the supply of digital content not on a tangible medium, if performance has begun with the Consumer’s express prior consent and acknowledgement that they thereby lose the right of withdrawal, and the Seller has provided confirmation (point 13). The Consumer gives this consent by ticking the relevant box when placing the order.
Complaints
The Seller is liable for the conformity of the Product with the contract under the Polish Consumer Rights Act – for non-conformity existing at delivery and revealed within 2 years. The used nature of personal items, described in the offer, is a characteristic of the Product, not a non-conformity. Submit a complaint by e-mail to fetish.businesswoman@gmail.com or in writing to the Seller’s address, stating the order number, description of the non-conformity and your request (repair, replacement, price reduction or withdrawal from the contract). We reply within 14 days. The Seller does not provide a commercial guarantee.
Out-of-court dispute resolution
Consumers may seek assistance from municipal or district consumer ombudsmen, the voivodeship Trade Inspection and consumer organisations (more at uokik.gov.pl).
