Right of withdrawal (14-day return)
A consumer, and a sole trader with consumer rights, may withdraw from a distance contract within 14 days of receiving the goods, without giving a reason. To do so, send an unequivocal statement to: fetish.businesswoman@gmail.com and return the goods to: Bangla Unlimited Karol Otreba, Mickiewicza 23/1, 76-200 Slupsk, Poland, VAT ID (NIP) 8392860752 no later than 14 days from the day the statement was made. The direct cost of return shipping is borne by the buyer.
All payments received (including the cost of the cheapest delivery option offered) are refunded without undue delay, and no later than 14 days from receipt of the statement, using the same payment method, unless agreed otherwise. We may withhold the refund until we receive the goods back or proof that they have been sent.
Exceptions – when the right of withdrawal does not apply
Under Article 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply, among others, to contracts:
- for goods delivered in sealed packaging which cannot be returned once opened for reasons of health protection or hygiene – this applies in particular to lingerie, worn clothing and other items of personal use offered in this shop, where the seal has been broken after delivery;
- for the supply of digital content not delivered on a tangible medium (e.g. PDF files, photographs, recordings), where performance began with the buyer’s express consent before the withdrawal period expired and after the buyer was informed of the loss of that right;
- for non-prefabricated goods made to the buyer’s specification or serving their individualised needs (personalised orders).
Complaints
The Seller is liable for the conformity of goods with the contract under the Polish Consumer Rights Act (as a rule for 2 years from delivery). The nature of the products offered – including the fact that some of them are used or worn items, which is a characteristic described in the listing – forms part of the contract. Submit a complaint to: fetish.businesswoman@gmail.com, describing the non-conformity and enclosing proof of purchase. We reply within 14 days.
Out-of-court dispute resolution
A consumer may use out-of-court procedures for handling complaints and pursuing claims, including assistance from a municipal or district consumer ombudsman in Poland and the EU ODR platform.
